In February, the Honorable Judge Eldon E. Fallon issued an order approving five (5) class action settlements with manufacturers, builders, suppliers and installers of Chinese drywall and their various insurers. Judge Fallon recently issued an order announcing that those individuals and businesses interested in participating in a Settlement must register on or before June 24, 2013 to be eligible to participate in these Settlements. These settlements are estimated to be in excess of $1 billion, and will benefit more than 10,000 property owners whose homes and properties were damaged by defective Chinese drywall. A fairness hearing on this settlement took place in November 2012.

The court’s order certified five (5) Class Action Settlements with the following Defendants:
(1) In Ex – Interior Exterior Building Supply, LP and its insurers;
(2) Banner – the Banner entities and their insurers;
(3) L&W – the L&W Supply Corporation and USG Corporation;
(4) Knauf Defendants; and
(5) The Global Settlement – 700 additional Participating Builders, Suppliers, and Installers and their Participating Insurers.
HH&K partner Russ Herman serves as court-appointed liaison counsel in the Chinese Drywall Federal litigation, MDL 2047, and the firm has previously set precedents in this litigation with its leadership in the 2010 Hernandez case and negotiating the Knauf Pilot Program, which was initiated in the fall of 2010.
